Case
Client was injured when a recently installed built-in refrigerator was incorrectly installed and crushed her foot.
Reason for FG
The jurisdiction was a pure contributory negligence state, and the defense alleged that the client was partly at fault in causing the injury. They alleged that she was negligent to ask them to install the refrigerator in the garage instead of a kitchen. They also alleged it had tape on the side warning that it wasn’t safe to use.
Unexpected Insight
The panel of mock jurors did not believe that the client was partly at-fault because the installers left the house and told her the job was complete. The act of the installers leaving the house, despite leaving the tape, was enough for the jurors to believe she was not negligent using the fridge. These insights were very useful at mediation.
Rear-ended by a Commercial Truck
Case
The client was rear-ended by a commercial truck with 9 figure coverage limits. The client suffered catastrophic orthopedic injuries with permanent injuries. The client was an excellent witness and very sympathetic.
Reason for FG
The client made a very strong physical recovery after dedicating himself tirelessly to rehabilitation. The legal team wanted to assess what impact his nearly miraculous recovery had on the jury’s damages assessment. The legal team also wanted to understand the mock juror’s opinions regarding the life care plan.
Unexpected Insight
The panel of mock jurors acknowledged the strong recovery. However, they believed this added value to the case because the client worked so hard during physical therapy. Since the client was working so hard, but would never get to 100%, they believed this made the damages case even more compelling. The jurors also added interesting insights into potential modifications to the client’s home. The legal team took these findings to the life care planner, which led to improvements to the life care plan.
